What happens when Trustee Refuses to Pay Beneficiary?
Answer: It is time to hire an attorney. The attorney should promptly fire off a trust accounting demand letter.
Bring a copy of the trust agreement when meet with the attorney. If not, I can get a copy in the demand.
How the trustee responds will be the Big Tell? Either they open their books and share accountings, statement, the trust agreements and it all works out (doubtful <5% chance)
or
The trustee goes dark or responds in ugly fashion. When this happens it's time to go full Petition to Remove Trustee mode on them. *Note, I'm discussing NC law and our Uniform Trustee Code - see link to the chapter in the North Carolina General Statutes here: https://www.ncleg.gov/Laws/GeneralStatuteSections/Chapter36C Check out the duties to administer, of loyalty, impartiality, prudent administration, skills, delegation, protection of trust property, as well as DUTY TO INFORM AND REPORT (36c-8-813)
Kirk Sanders and his team of fiduciary litigation attorneys and staff handle these fiduciary violation cases all the time.
We enjoy going after trustees who refuse to perform their duties, who steal from the trust and its beneficiaries, who dabble in self-dealing situations. In other words: we take pleasure going after thieves for you, our aggrieved clients.
